Ryan S told me to spread this around because apparently a lot of people are getting this problem:

the fix - the battle.net folder is a fully intact, non-corrupt one that you place in your c:\programdata\. Make sure you delete your current one first to replace the one that actually works.

After it is placed, go into the agent\agent.913 folder and double click the agent.exe, it should bring up a command prompt.

Next, right click your Diablo 3 setup.exe and run as admin, it should basically skip the "updating setup files" and go right into the game install.

And there's your fix, I have confirmed that this works, and it's on blizzards forums.
